Acceptance of Terms
Before you use the Services, we require that you read and accept these Terms of Service. If you visit, shop, or otherwise participate in the Services on the Site, you accept these Terms of Service. If you choose not to accept these Terms of Service, you may not access or otherwise use the Site or Services. In addition, when using particular 0degreegallery.com owned or operated services, you shall be subject to any posted policies, guidelines or rules applicable to such services. All such policies, guidelines and rules are hereby incorporated by reference into the Terms of Service.
Amendment
0degreegallery.com reserves the right to make any alternation to these Conditions at its sole discretion at any time 0degreegallery.com considers proper. The altered version is and becomes automatically effective on he date it is altered and is to be published in the way 0degreegallery.com considers proper. Any party involved must pay attention to any such alternations of these Conditions and 0degreegallery.com shall under no conditions be liable to any separate notice. Your continued use of the Site and the Services after such changes are posted will constitute your agreement to such changed Terms of Service. These Terms of Service were last revised on April 09th, 2009.
Confidentiality
0degreegallery.com never share personal information related to subscribers or customers with third parties. 0degreegallery.com ensure that all personal information held within our databases is secure.
Registration of Artist
In order to participate in the Services, you must register with 0degreegallery.com by sending us an email to artist@0degreegallery.com and providing certain information including some of your artworks to 0degreegallery.com. All information about yourself as prompted by 0degreegallery.com registration must be true, accurate, current and complete, if you provide any information that is unture, inaccurate, not current or incomplete, 0degreegallery.com reserves the right to suspend or terminate your account. When 0degreegallery.com has notified you that your registration form has been approved, you will receive a Username and Password. When you are becoming a "Registered User", you can upload or modify your own artworks & its descriptions.
Acceptance of Artist
0degreegallery.com reserves the right to accept or decline your application to market Artworks through 0degreegallery.com. Your application includes your Acceptance of these Terms and Conditions. You warrant that all information supplied to 0degreegallery.com is accurate, and up to date. You agree to have your artworks and descriptive information displayed on 0degreegallery.com. You will inform 0degreegallery.com of any changes in the information stored by 0degreegallery.com including name, address and contact details, pricing of Artworks, and the Sold status of Artworks.
Acceptance of Artworks
0degreegallery.com reserves the right to accept or decline your application to market any Artwork through 0degreegallery.com for any reason at our sole discretion. If accepted, you are offering your Artwork for sale for a minimum period of six months, or until sold, whichever is the sooner. After period of six months, if your artwork cannot be sold, 0degreegallery.com reserves the right to remove your artwork from the Website. If a sale is made you are entering into a legally binding contract with 0degreegallery.com to complete the sale and dispatch the artwork in the agreed time.
Non-exclusivity
You may market your Artwork through other channels simultaneously with marketing through 0degreegallery.com provided. This does not affect your ability to deliver the Artwork to the Customer or 0degreegallery.com within the specified time. You do not offer your Artwork at a price lower than the price, which you are offering it through 0degreegallery.com. If the Artwork is sold through another channel you will immediately remove it from sale at 0degreegallery.com
Copyright
You warrant that all work sold through the Site is free of any copyright restrictions or intellectual property disputes. You warrant the Work is yours to sell. The copyright in the Artwork will remain with you even after ownership of the Artwork is transferred to the Customer. If you believe that your Artwork(s) of another user has been wrongfully used in a way that constitutes copyright infringement, 0degreegallery.com asks you to contact them directly. Any infringement of copyright, trademark, patent, publicity rights or other right comes to the attention of 0degreegallery.com, 0degreegallery.com reserves the right to delete all infringing material from the Site and to suspend you from using the services, even without receiving a complaint from the person whose rights have been infringed.
Photo of Presentation
The buyer agrees that the images of the Artwork(s) on the Website are guidelines only. In case that the one, color, graduation and shape shown in any other images differs from those of the original artwork(s), photograph and other technical reasons, the original shall take precedence. 0degreegallery.com will accept no responsibility for differences between the Website Images and the actual Artwork(s). Artist must supply at a high-quality digital photo of each Artwork (at least 640 x 480 pixels) you wish to sell through 0degreegallery.com. The Image must be in JPEG format and will show the entire artwork
Pricing
You will choose the price that the Artwork should be sold for, including 0degreegallery.com's commission. 0degreegallery.com will notify you in advance of the commission rate applicable to you, once accepted you agree to sell the artwork at the accepted price. 0degreegallery.com reserves the right to change these Prices within 0degreegallery.com’s commission at any time without prior notice.
Delivery, packaging and insurance
You are responsible and liable for costs of all materials, packaging, delivery and insurance costs. These costs cannot be reclaimed from 0degreegallery.com under any circumstances and should be taken into account when pricing Your Artworks. You will ensure that Artworks are securely packaged, labeled and adequately insured for safe delivery to the Customer or 0degreegallery.com. You will not include any contact details that would encourage the customer to deal directly with you in the packaging, such as business cards, leaflets, letters of solicitation for business etc., except you is Premium Member. You will package and arrange delivery of Artworks to the Customer or 0degreegallery.com within 7 working days of receiving the order. The Artwork must arrive with the Customer or 0degreegallery.com no later than 10working days after you have received the order. Should you become aware of any reason why an Artwork that has been ordered from you may not be received by the Customer or 0degreegaleery.com within 7 days, you will notify 0degreegallery.com immediately of the reason for and expected length of the delay. 0degreegallery.com will attempt to contact the customer and in some cases may offer a refund to the Customer resulting in the cancellation of the order from you.
Damaged goods, Refunds and Return Policy
0degreegallery.com may arrange packing and handling of the purchased lot on behalf of the buyer as the case may be on its request and the Buyer shall be liable for any loss arising from such arrangement. In the event of the Artwork arriving damaged with the Customer or 0degreegallery.com, you will be liable for the costs of retrieving the artwork. You will claim any costs in retrieving the Artwork through the insurance cover provided by your chosen courier. In no circumstances shall we take any liability for any damages or losses of glass, frames, drawers, bottom mat, trestle, mounting, insert pages, roller or other similar accessories arising out of any reason. 0degreegallery.com will not accept claims for reimbursement in the event of damage to Artworks under any circumstances. You accept that if you have not taken adequate insurance, you will be liable for the costs of retrieving the Artwork. You accept that the Customer or 0degreegallery.com may return the Artwork(s) within 14 days of receipt, and may receive a full refundable payment and this will constitute cancellation of the order. 0degreegallery.com will not accept liability for your delivery expenses in this instance.
The buyer must notify 0degreegallery.com within 7 days from the date of receipt of the Artwork(s) by e-mail to refund@0degreegallery.com of any intended return, no returns will be accepted after such period, all sales are confirmed.
The buyer may return any Artworks(s) acquired for a complete refund, provided that:
1) Returns of Artwork(s) from the buyer need to receive the confirmation email by 0degreegallery.com, Including details of the return address. The Artwork(s) shall be returned in same condition received and within 7 days from the date of notification of such return.
2) The buyer is responsible for return shipping costs including insurance. In addition, 0degreegallery.com will undertake no liability for any fault, omissions, damages or losses caused by the packers or carriers that recommend by the buyer. There is no right to return the Artwork(s) where the Artwork(s) have been made to the Buyer’s specifications or have been personalized or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.
Payment
The Invoice will be paid immediately by 0degreegallery.com upon receipt of the Artwork. Payment may be carried out by cheque, bank transfers or Pay pal. Cash on delivery, if you choose this mode of payment, this option is applicable only for courier-delivered orders. When the buyer or 0degreegallery.com received artwork(s), we will pass the cheque to the delivery person in the exact amount (This Service must arrange and research by the seller).
Tax Responsibility
The seller shall file all sales tax returns in accordance with applicable law, and each seller shall indemnify 0degreegallery.com against any tax, cost or expense relating to the failure of such seller to satisfy any tax liability related to the sale of such seller's Artwork(s).
Ownership of Customer relationship
You agree that the business relationship between the Customer and 0degreegallery.com is entirely owned by 0degreegallery.com. You will not approach the Customer directly or correspond with the Customer in any way, except you are Premium Member of 0degreegallery.com or with express written authorization from 0degreegallery.com. You will not sell directly to the Customer or allow a direct relationship to develop between you and the Customer that could be detrimental to 0degreegallery.com. You will not pass your contact details to the Customer, including in Artwork packaging. In the event of a return or damaged goods claim, we will release your details to the Customer.

Disclaimer
0degreegallery.com do not accept liability for any loss or damage that users may suffer as a result of using any part or function of the website including as a result of downtime or technical problems with the website. 0degreegallery.com also do not accept any liability for any content published on the website by a member being copied and misrepresented by a third party. 0degreegallery.com do not guarantee that the service will be free from errors, uninterrupted, free from occasional downtime, and display automatically all content upload by the third member.
Dealings with Advertisers
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through 0degreegallery.com, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that 0degreegallery.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on 0degreegallery.com.
Exemption
0degreegallery.com, acting as agent of the Seller, shall undertake no liability for any breach of contract by he Buyer or the Seller.
Language
These Conditions are written in English and Chinese. The Chinese version is only for reference. In case of any discrepancy between the English version and Chinese version, the English, as the official version, shall prevail.
